These terms govern use of metermark.ai, the Metermark dashboard, API, MCP server, and agent (together, the “Service”), provided by Metermark (“we”, “us”). By creating an account or installing the agent you agree to them. If you use the Service on behalf of an organization, you confirm you are authorized to bind it.
Accounts
You are responsible for activity under your account and for keeping API keys and sign-in credentials confidential. Tell us promptly at hi@metermark.aiif you believe an account or key has been compromised.
Your data
You own the data the Service collects on your behalf. You grant us the rights needed to operate the Service for you: to store usage metadata, compute dashboards and benchmarks, and return it to you and the people your organization authorizes. Our handling of personal data is described in the Privacy Policy. Aggregate, de-identified statistics that cannot be traced to a person or organization may be used to improve the Service.
Acceptable use
Install the agent only on machines you own or are authorized to monitor, and only where the people using them have been told, as your local law requires. Do not use the Service to surveil individuals outside that scope, to break the law, or to probe or disrupt our systems. Do not resell the Service or use it to build a competing product from our data.
Plans and billing
The free plan is limited by the monthly quotas shown in the product. Paid plans are billed per seat, in advance, through Stripe, and renew until cancelled. Seats added mid-period are prorated. Fees are non-refundable except where the law requires otherwise. We may change prices with at least 30 days notice before your next renewal.
Availability and changes
We work to keep the Service available and will give reasonable notice of changes that materially reduce functionality. We may suspend access to protect the Service or other customers, and will tell you why when we can.
Intellectual property
The Service, including its software, design, and documentation, is ours or our licensors’. Feedback you give us may be used without obligation.
Disclaimers and liability
The Service is provided “as is”. Cost figures and classifications are estimates and may differ from your vendors’ invoices. To the fullest extent permitted by law, we disclaim implied warranties, and our total liability for any claim arising from the Service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential damages.
Termination
You may stop using the Service and delete your account at any time. We may terminate for breach of these terms after notice where practical. Sections that by their nature should survive termination do.
Governing law
These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules, and disputes will be brought in the courts located there.
Changes to these terms
We may update these terms; the date at the top shows the current version. Material changes are announced in the dashboard before they take effect. Continued use after that is acceptance.
